Introduction: By visiting www.misfitisle.com you agree to abide by the Terms of Service described below. These rules and guidelines have been designed to protect you and to ensure that www.misfitisle.com is safe, fun, and rewarding experience for everyone. Should someone use bad language, make a harassing statement, or otherwise behave in an un-professional or un-dignified manner, we will be able to do something about it. If you encounter another member who isn’t abiding by these rules, please contact us. By agreeing to these terms, you are taking responsibility for your own actions. Children’s Online Privacy Protection Act: MisfitIsle does not encourage, solicit, or permit visitors who are known to be under the age of 13 to visit the MisfitIsle Site. Acceptance of Terms of Service: The access to MisfitIsle’s site is provided, free of charge, to you by www.misfitisle.com, (aka ’MisfitIsle’ under these Terms of Service). Although portions of MisfitIsle’s site may be viewed simply by visiting the site, in order to receive additional services from MisfitIsle you need to register as a member of MisfitIsle’s site. If you register as a member of MisfitIsle’s site community, these Terms of Service will govern your use of MisfitIsle’s site, including access to message boards and other features.

BY COMPLETING THE REGISTRATION PROCESS, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF SERVICE AND SUCH TERMS MAY BE MODIFIED FROM TIME TO TIME.

These Terms of Service govern your use of MisfitIsle’s site and all services provided in connection with MisfitIsle’s site. MisfitIsle shall not be liable to you for any breach of these Terms of Service. In addition, MisfitIsle does not bear any fiduciary responsibility to any user of this website. If you do not agree to these Terms of Service, do not register for or enter MisfitIsle’s site. The Terms of Service for your continued use of MisfitIsle’s site will be posted on the MisfitIsle site. Please check this area before using MisfitIsle’s site to determine whether a change has been made to these Terms of Service. If you do not agree to these changes in the Terms of Service as they may occur, please arrange to terminate your registration with MisfitIsle’s site immediately (i) by notifying MisfitIsle of your unwillingness to accept the changes to the Terms of Service; and (ii) by discontinuing your use of MisfitIsle’s site. Your continued use of MisfitIsle’s site shall be construed as, and shall constitute your acceptance of any and all changes in the terms and conditions set forth herein.

From time to time MisfitIsle may supplement these Terms of Service with additional Terms pertaining to specific content or events (’Additional Terms’), which Additional Terms may be placed on MisfitIsle’s site to be viewed in connection with the specific content or events and shall be identified as such. You understand and agree that such Additional Terms are hereby incorporated by reference into these Terms of Service.; Top

Personal Information: When you complete the registration process, MisfitIsle requires that you provide a valid e-mail address, which will be protected pursuant to the Privacy Act and the Freedom of Information Act and will not be given out to a third party.

If you would like your name deactivated from MisfitIsle’s lists, please send an e-mail to us at admin@misfitisle.com to request that MisfitIsle deactivate you from its lists. Be sure to include your username and password, in order to prove the request comes from you. MisfitIsle will use reasonable efforts to honor your requests, but we appreciate your patience in allowing us a reasonable amount of time for processing.; Top

Cookies: A cookie is small amount of data that is transferred to your browser by a Web server and can only be read by the server that gave it to you. It cannot be executed as code or deliver viruses. Furthermore, while MisfitIsle uses cookies to mark your read posts, and our Web servers automatically log the IP/Internet address of your computer when you post, this information does not identify you personally unless you have otherwise provided MisfitIsle with personal information.

Content of Messages: You also agree not to use MisfitIsle’s site to send or post on forums, chat rooms, or any place on MisfitIsle’s site, any message or material that is unlawful, harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, or encourage the use of controlled substances. MisfitIsle reserves the right to delete any such material from MisfitIsle’s site. MisfitIsle will cooperate fully with any law enforcement officials and/or agencies in the investigation of any person or persons who violate the Terms of Service contained in this section.

You agree not to post or use MisfitIsle’s site to distribute or send any illegal material of any kind, including but not limited to, illegal material in the form of text, graphics, video, programs or audio files.

Posting content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited.

You acknowledge that (i) MisfitIsle permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights (’Rights’ in this terms of service); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, the Terms of Service and applicable copyright, trademark and other laws govern your use of such content. You may not post to MisfitIsle’s site, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that Rights do not protect any information, software, images or any other content on MisfitIsle’s site rests with you. Indemnification: You agree to indemnify and hold each administrator, moderator, host, and/or greeter of MisfitIsle harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of MisfitIsle’s site, the violation of these Terms of Service by you, or the infringement by you, or any other user of your account, of any intellectual property or other right of any person or entity.; Top

Applicable Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to conflicts of laws provisions thereof. The sole jurisdiction and venue for actions related to the subject matter hereof shall be Kentucky State and U.S. Federal courts sitting in the County of Jefferson or, the Kentucky State and U.S. Federal courts having within their jurisdiction the location of MisfitIsle’s principal place of business. In any action or proceeding to enforce rights under this Agreement, the prevailing party will be entitled to recover costs and attorneys’ fees.; Top

Remedies for Breach of these Terms by You: In the event that MisfitIsle determines, at its sole discretion, that you have breached any portion of these Terms of Service, or have otherwise demonstrated conduct inappropriate for the community of MisfitIsle’s site, MisfitIsle reserves the right to (i) warn you via private message or email that you have violated these Terms of Service; (ii) delete any content provided by you or your agent(s) to MisfitIsle’s site, (iii) delete all content provided by you to MisfitIsle’s site, (iv) limit access or discontinue your registration with MisfitIsle’s site and chat rooms; (v) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities for further action; and/or (vi) any other action which MisfitIsle deems to be appropriate.; Top

Miscellaneous: In the event that any provision of the Terms of Service conflicts with the law under which the Terms of Service are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to the Terms of Service, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these Terms of Service will remain in full force and effect.

The failure of either party to insist upon or enforce strict performance by the other party of any provision of the Terms of Service or to exercise any right under the Terms of Service will not be construed as a waiver or relinquishment to any extent of such party’s right to assert or rely upon any such provision or right in that or any other instance, rather, the same will be and remain in full force and effect.

MisfitIsle may assign its rights and obligations under these Terms of Service and upon such assignment MisfitIsle may be relieved of any further obligation hereunder.

You represent to MisfitIsle that you have the authority to register with MisfitIsle’s site according to these Terms of Service.

These Terms of Service and any Additional Terms (as such terms shall be identified when posted on MisfitIsle’s site by MisfitIsle) constitute the entire understanding between the parties as to the subject matter herein, and supersede all prior agreements and understandings. Any legally unenforceable provision of these Terms of Service will, at the election of MisfitIsle, be deleted or modified to correct the defect and, regardless, the remainder of the terms of these Terms of Service will remain valid and enforceable.; Top

Forum and Chat Room Rules

Message Liability: All messages express the views of the author, and are not and should not be taken as representative of the official policies of the forum or the views of its staff, unless explicitly stated as such by the authoritative members of the staff. While the administrators and moderators of this forum will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every message. Therefore you acknowledge that all posts made to these forums express the views and opinions of the author and not the administrators, moderators or webmaster (except for posts by these people) and hence will not be held liable.; Top

Conversations: All members, at the staff’s discretion, must converse in an acceptable fashion to be allowed the privilege of continued participation.; Top

Database Storage: As a user, you agree to any information you enter being stored in a database. While this information will not be disclosed to any third party, the MisfitIsle staff cannot be held responsible for the possible corruption of this data by illegal activities propagated by malicious users. All members must acknowledge and accept that data integrity is not the liability of the MisfitIsle staff. Those who do not accept this should not contribute any content whatsoever to the MisfitIsle community.; Top

Email Address: The MisfitIsle community requires that all members provide a valid email address. This email address will only be used for user account validation and activities directly related to the features of this community, such as confirming your registration details and your password (and for sending new passwords in case you forgot your current one) and for site-related news considered of great importance by the administrators. Email addresses will never be given to any third party.; Top

Topics: All members that post to the MisfitIsle community must acknowledge and discuss only acceptable topics when starting a new thread. If posting to an already existing thread, they must continue in the vein of discussion that the thread has already manifested; if they wish to change topics, they must start a new thread. Many of the threads within the MisfitIsle forums, which would have otherwise been good resources for information, could be rendered uninformative and confusing because of the discussion drifting off topic. This would make the forum less useful as a resource and may lead to questions and posts of information being repeated unnecessarily. This could possibly cause people to lose interest in participation; therefore, please respect this rule.; Top

Threads: All members that create new threads must use a topic title which is understandable and describes the content of the thread properly. Furthermore, all new threads must be started in the correct forum categories, and posted only once -- in the appropriate category -- throughout the entire forum. Double posts will be removed, and threads with inappropriate topics will be moved.; Top

Staff Authority: All members must acknowledge the authority of the staff insofar as administrative actions are concerned. These issues are no longer open for discussion once the staff member has indicated that the matter is closed. Further concerns regarding an action should be communicated via a private message to the staff member, and not repeatedly discussed publicly. Furthermore, once a thread on a particular topic has been closed or removed and indicated as being unacceptable by a staff member, no starting a new discussion on the exact same topic. If you do not understand why a thread was closed or information removed, contact one of the administrators/moderators privately.; Top

Copyright: All members must refrain from posting links to -- or information regarding how to obtain -- copyrighted or illegal material. Discussion containing information of how to obtain such material, how to bypass protection methodologies of such material, or how to otherwise violate laws pertaining to such matters will not be tolerated. Do not post entire non-original stories or articles in whole; small excerpts and links should always be used to ensure copyright laws are not violated.; Top

Signatures: All member signatures must be kept brief -- 3 to 4 lines at most. Signatures and avatars must also be non-obtrusive, non-offensive and work-safe. It is not allowed to have a signature longer than a few lines. Signatures may not link to offensive sites or have offensive content. No commercial advertising.; Top

Accounts: All members are only allowed to have a single user account with the forums.; Top

Advertising: All members must refrain from using the forum solely for advertising purposes.; Top

Acceptable Behavior: You agree not to post in the forums, or say in the chat rooms, anything abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or unlawful. This material, deemed as such by the MisfitIsle staff, and at their sole discretion, will be removed from the forums and the participating user(s) will have temporarily restricted access, to the forums and/or the chat rooms, for an amount of time deemed appropriate by the MisfitIsle staff. Further administrative action will be taken if the violation continues. This may include reporting you to the proper authorities such as law enforcement agencies or internet service providers. Logs of all forum activity, including the IP address of all posts, are recorded to aid in enforcement of these conditions. If any user should witness this behavior in the chat room, please notify MisfitIsle staff with a copy of the offense.; Top

Suicide: We are not equipped to properly help people who are contemplating suicide; we want to keep you safe by encouraging you to seek professional assistance. We are not trained to be a suicide hotline; please contact a suicide hotline, your personal physician, a hospital emergency room or your local 911 or emergency contact number for professional assistance.

MisfitIsle does not permit discussion of suicidal thoughts or self-harm. This is for the safety of all members. Talking about suicidal thoughts and feelings can be very traumatic to others who have no way of helping and may be on the other side of the world. It is important to talk about these feelings - but to someone who is trained to help.

If you give your personal information to a host or other member and later threaten suicide we reserve the right to contact appropriate authorities, however, no guarantee is made that someone will contact emergency personnel for you.; Top

Spam: Unless you are a staff member making an announcement or hosting a show or game, do not type in all bold or caps. A non-English forum or chat discussion excludes a large section of the users from the ongoing discussion; have consideration for other members. Do not use elite (’1337’) speak or uncommon abbreviations. To use the above degrades the quality of the forum and chat rooms, since most users will not be able to understand their content, and will therefore be considered SPAM. Such posts will be removed from the forums, and further action may be taken if continued in either the forums or chat rooms.; Top

Agreement: By registering, you state that you are over the age of 13 and agree to be bound by these conditions.; Top

Staff Rules

Requirements: Qualifications: Staff members must be hard workers and team players. Staff members must be willing to dedicate the required amount of time in fulfillment of their duties.

Participation: All staff members must read their forums at least once a week and make attempts to keep the forum active. Staff members should visit the staff forums, the Bulletin Board forum, and the forums under their supervision at least once a week to keep up on their duties, current activities, discussions, issues, etc. All staff members should make an attempt to attend as many staff meetings as possible.

Acceptable Behavior: All staff members are expected to conduct themselves in a courteous and professional manner. This includes participation in any outside online forums, chat rooms, or blogs, since others may view staff members as representatives of MisfitIsle (especially if a staff position at MisfitIsle is indicated in some manner, such as a forum signature). Staff members must not abuse the privilege of their position.

Reporting: Staff members must notify the Administrators when there are changes to contact information, such as e-mail addresses. Staff members must respond to e-mails in a timely manner. Staff members should not transfer or take on the additional duties of another staff member unless approved by an Administrator. Each staff position may have its own unique requirements in addition to those listed above.; Top

Disciplinary Action: Member Disciplinary Action: The following series of disciplinary actions may be enacted:
First offense: Warning*
Second offense: Temporary suspension of posting, approval is needed before a post can be made
Third offense: Temporary banning**
Fourth offense: Permanent banning***

*Member Warning: Warnings are to be handed out through a private message, a copy of which should also be sent to all Administrators. If the infraction is harmless and is considered minor, only a written warning is needed. However, if the infraction is harmful or is considered major, further action may be taken by an Administrator. In handing out a warning, the staff member MUST include evidence in the reasoning. If no evidence is given, the warning will be removed, no questions asked. Staff members must post in the staff forums if they warn a member, again including evidence.

Member Banning: Bannings are to be handed out through an email, a copy of which should also be sent to all Administrators. Staff Disciplinary Action: In the event a staff member has shown himself or herself to be incapable of performing his or her required duties, the following series of disciplinary actions may be enacted:
First offense: Warning*
Second offense: Warning*
Third offense: Temporary demotion with another staff member taking over the position**
Fourth offense: Removal from staff with loss of all staff benefits***

Confidentiality: Privacy and Non-Disclosure: Any information shared or conversations conducted in staff meetings or staff forums should be considered private and confidential and not shared with anyone who is not a staff member until such time that the Administrators are ready to make a public announcement or statement. Anyone caught leaking unapproved information out of the staff room will be relieved of their staff position immediately. MisfitIsle must protect the personal information of its staff and members. Personal information should not be shared with third parties at any time.

Conflict and Disagreement: Staff members should not publicly express disagreement or dissatisfaction with the official position or policy of MisfitIsle. If a staff member is dissatisfied or has other issues, it should be handled privately or in the staff forums. Staff members should not publicly argue or insult anyone else in MisfitIsle, all issues should be handled privately.; Top

Warned Members Moderators make decisions regarding only the forums under their supervision. Global Moderator(s) make decisions regarding all forums, but cannot override a decision made by Moderator(s). Co-Administrator(s) can override any decision made by Moderator(s) and Global Moderator(s). Administrator(s) can override all decision. The Administrators can edit the rules at anytime and add or remove staff permissions; however, Administrators will try to discuss possible changes with staff members before making the final decision.; Top

Staff Rights: All staff members will be treated with respect and gratitude. All staff members have the right to call for a vote if they feel that a rule should be changed or an addition be made. Staff members that quit may return after a period of six months to one year. Any staff member that has a personal issue is allowed to take a break for up to three months, no questions asked, without losing staff benefits. However, arrangements will need to be made beforehand, and the staff member will need to fulfill the obligatory duties after the three months or step down, unless special permission is gained from all Administrators.; Top
